Client is responsible to get prior permission from
photographer to videotape formal photography sessions. It is the responsibility
of Client to secure permission from church, synagogue, or other officials to
videotape the ceremony. THE DEPOSIT IS NON-REFUNDABLE IF SUCH OFFICIALS PREVENT
VIDEOTAPING. Paragon Visual Productions will abide by the rules of the church
or synagogue regarding camera placement at the ceremony.
Client is to provide music, photos, and other material prior
to wedding day.
Paragon Visual Productions will take utmost care with
Client-furnished materials, but shall not be held liable beyond raw stock and
processing costs in the event of loss or damage to said items.
Paragon Visual Productions will take utmost care to produce
a tape or DVD of excellent quality; however, we will not be responsible for
circumstances beyond our control, including, but not limited to, power failure,
equipment malfunction, and defective tape stock. If taping is prevented due to
such occurrences, Client will be refunded all deposits paid.
If sickness or emergency renders Paragon Visual Productions
unable to perform the services agreed upon, Client will be refunded all
payment. Paragon Visual Productions
will be under no further obligation to Client.
Any or all original videotapes and DVD’s are the sole
property of Paragon Visual Productions, and may be used for advertising,
display, or any purpose thought proper. Unauthorized duplication is prohibited.
Paragon Visual Productions reserves full control over
editing, unless otherwise agreed to in writing, and makes no guarantees,
expressed or implied, in regard to the aesthetic qualities of completed
product. Any special editing requests must be made prior to wedding date.
Client has five (5) days from delivery of finished product to request
editing changes. The first two hours of re-editing are complimentary;
additional editing will be charged at a rate of $75 per hour. Additional copies on VHS
or DVD can be requested at any time.
Certain older DVD players may not play DVD-R discs, or may
play them improperly. Client is responsible for verifying DVD-R compatibility
of target player before ordering copies on DVD.
In the event of a payment default, Client is responsible for
all costs of collection, including attorney fees and court costs. There will be a $50 charge for all returned
checks.
Under any and all circumstances, Paragon Visual Productions’
liability is limited to the refund of all payments made.
Meal(s) and seating (if possible within sight of the
festivities) will be provided to Paragon Visual Productions’ personnel, should
the assignment encompass a time that a meal is being provided to guests.
This Agreement shall insure to the benefit of and be binding
upon the parties and their representatives and, except as specifically provided
herein, neither party may make any assignment of this Agreement or any interest
therein without the prior written consent of the other party. It is understood and agreed that Paragon
Visual Productions shall have the right to assign this Agreement to any
successor, or to any direct or indirect subsidiary of said Client.
